Abstract

This article is a brief discussion of the importance of cultural identity/expression in Africa as an aspect of self-determination of an ethnic group and the current challenges of absolute enjoyment of this right. Much complexity exists in preserving both this group right and protection of individual rights against violations of harmful cultural practices. Finding that delicate balance under the contemporary regional human rights framework is the hope of this article. The paper will therefore define culture, describe its importance in African society, cultural expression as a human right, historical and developing limitations to culture and conflict points with other human rights. Legal and extra-legal solutions are proposed at the end.
